Terms of Use

1. Acceptance of Terms

By accessing or using Winery (“the Service”), you agree to these Terms of Use. If you do not agree, do not use the Service.

2. Description of Service

Winery is a winery directory, review, and deals platform. We aggregate publicly available data from government registries (TTB FOIA), OpenStreetMap (ODbL), and Wikidata (CC0). Third-party ratings from Yelp and Google are displayed as separate, attributed, live-only modules — never merged into our first-party review scores.

3. User Content

Users may submit reviews, photos, comments, and votes. By submitting content, you grant Winery a non-exclusive, royalty-free license to display, distribute, and modify your content in connection with the Service. You retain ownership of your content.

You agree not to submit content that is false, defamatory, infringing, or violates any law. We reserve the right to remove any content at our discretion.

4. Business Listings

Business owners may claim and manage their listings. Claiming a listing requires verification of ownership. Business owners agree to provide accurate information and respond to reviews in good faith.

5. Advertising & Deals

Sponsored listings and paid advertisements are clearly labeled. Deals and offers are subject to the terms specified by the offering winery. Winery is not a party to transactions between users and businesses.

6. Third-Party Services

The Service integrates with third-party APIs subject to their respective terms:

  • Yelp: Yelp content is displayed in compliance with the Yelp Fusion API Terms of Service. Yelp content is not stored beyond 24 hours. Removal requests are honored within 24 hours. Yelp ratings are displayed separately and never blended with our ratings.
  • Google: Google Places data is displayed in compliance with Google Maps Platform Terms. Only place_id is stored permanently. Google content is displayed on Google Maps with required attribution.
  • OpenStreetMap: Used under the Open Database License (ODbL). Attribution is provided as required.
  • Wikidata: Used under CC0. Attribution is provided.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Winery and protected by copyright, trademark, and other laws.

8. Limitation of Liability

The Service is provided “as is” without warranties of any kind. Winery shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

9. Changes to Terms

We may modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the new terms.
